Dual Agency and its Risks
Dual agency arises when the same broker represents the buyer and seller in the same transaction. This might arise, for example, when an unrepresented buyer calls the listing agent directly to schedule a showing, or when an unrepresented buyer tours an open house and expresses interest in the home directly to the listing agent. It can also arise when a broker serves large numbers of buyers and sellers, which is common among the large and mid-sized brokerages in the Twin Cities. In this case, the unsuspecting buyer risks being steered toward the agent’s own listings.
Dual agency spoils the agent's role as a fiduciary, and both the buyer and seller lose their advocate at the moment they’re needed most. Meanwhile, the dual agent pockets both sides of the commission.
